AT A GLANCE
  • Local registration and cross-border recognition; current procedure and individual applicability need confirmation.
  • An advertised service or clinic acceptance policy is not proof of legal eligibility.

Separate the different records

A medical birth record, civil birth registration, legal parenthood decision and passport are not interchangeable. Each authority may ask a different legal question and require different evidence.

A birth certificate naming intended parents should not be assumed to settle recognition in another country. The home jurisdiction may apply different parenthood and nationality rules.

Establish the local legal basis

Article 104(7) in the January 2025 consolidation says the person or persons who contracted for embryo implantation in another woman for gestation are recorded as parents in the civil-status register when the child is born. Paragraphs 8–9 address refusal and financial consequences. This identifies a historical legal basis, not independent confirmation of today’s application procedure or every applicant category.

Ask counsel and the responsible civil registry to identify the current legal basis, medical evidence, agreements and identity documents needed for the actual case, including how donor material or family status affects it.

Investigate issues before pregnancy or birth

Confirm names and transliterations, marriage or relationship documents where relevant, the identity of the person giving birth and how the medical facility’s records will connect with civil registration.

Ask what happens if family circumstances change, records conflict, a party cannot attend, a pregnancy ends differently from expected or additional proof is requested.

Questions for the responsible professional

  • Who applies, to which authority, and on what current legal basis?
  • What additional evidence is required for foreign applicants or donor conception?
  • How will corrections, translations and certification be handled?

Plan recognition in the home jurisdiction

Obtain advice addressing whether and how the home jurisdiction recognises parenthood established abroad and whether a further order or procedure is required. Do not use a coordinator’s assurance as a substitute.

UK government overseas-surrogacy guidance recommends specialist advice in both jurisdictions and explains that bringing a child home can be complex. It does not supply a universal solution for every nationality.
